Terms and Conditions – 5dmaty (Operated by Mofawada E-Commerce W.L.L)

1. Introduction

This document applies to the mobile and web platform branded as 5dmaty or 5dmaty.ai, operated by Mofawada E-Commerce W.L.L. All uses of the name '5dmaty' in these Terms are inclusive of '5dmaty.ai'.

Welcome to 5dmaty! These Terms and Conditions ("Terms") govern your access to and use of the 5dmaty application and services ("App"), owned and operated by Mofawada E-Commerce W.L.L, a company registered in the Kingdom of Bahrain under CR No. 177421-1.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Mofawada E-Commerce W.L.L operates 5dmaty solely as an e-commerce intermediary platform. It is NOT a medical provider, health institution, product manufacturer, or service deliverer. The platform's role is limited to facilitating listings, searchability, communication, and transaction processing between Clients and independently registered Vendors.

2. Platform Overview

5dmaty is a digital platform that connects users ("Clients") with third-party providers ("Vendors") offering medical, wellness, diagnostic, or other services and related products. 5dmaty serves solely as an intermediary and does not provide or endorse any service or product listed.

3. Definitions

- "App": The mobile or web application operated under the brand 5dmaty.
- "Vendor": A business or individual offering services or products via the App.
- "Client": Any user purchasing or booking a service or product.
- "User": Any person or entity accessing the App, including Vendors and Clients.

4. Eligibility

- You must be 18 years or older or have parental/guardian consent to use the App.
- Vendors must be legally licensed and authorized to offer services/products under Bahraini law.

5. Role of 5dmaty

5dmaty bears no responsibility whatsoever for the outcomes, quality, legality, or safety of any medical, wellness, diagnostic, or commercial service offered through the platform. All liability, including for malpractice, delays, errors, damages, injuries, or disputes, lies solely with the service provider or vendor. Clients acknowledge that all services are delivered by third-party providers who are independently licensed and regulated.

5dmaty does not own, sell, deliver, or guarantee the quality of any service or product.
All transactions, appointments, deliveries, and disputes are strictly between Clients and Vendors.
The App facilitates listings, communication, bookings, and secure payments (via third parties).

6. User Obligations

All Users agree to:
- Provide truthful, accurate, and up-to-date information
- Use the App in accordance with applicable laws
- Avoid abusive or fraudulent behavior
- Honor bookings, prices, and agreed terms
- Use respectful and non-defamatory communication

7. Vendor Responsibilities

Vendors must:
- Provide valid licensing (e.g., CR number, medical license)
- Clearly describe service scope, pricing, and terms
- Fulfill bookings professionally and on time
- Respond to client messages and issues promptly
- Handle complaints or refund requests directly

8. Client Responsibilities

Clients must:
- Provide accurate booking and contact information
- Be present for in-person appointments
- Review vendor terms and conditions before booking
- Pay all agreed charges promptly
- Report issues within 7 days of occurrence

9. Payments

- Payments are handled through third-party payment providers.
- 5dmaty does not store or access card or banking information.
- Any transaction errors must be resolved with the respective payment gateway.

10. Cancellations and Refunds

- Clients may cancel or reschedule services up to 24 hours in advance.
- Late cancellations may incur fees (10–20%) as per Vendor policy.
- Vendors are responsible for refund eligibility and terms.

11. Reviews and Ratings

- Clients may leave reviews after service completion.
- 5dmaty reserves the right to remove inappropriate or fraudulent reviews.
- Vendors may respond to reviews but must remain professional.

12. Prohibited Activities

Users may not:
- Use the App for illegal purposes
- Upload harmful or misleading content
- Attempt to hack, disrupt, or exploit the platform
- Share other users' data without permission
- Promote counterfeit, harmful, or restricted items

13. Data Protection and Privacy

- All personal data is collected and processed in accordance with our Privacy Policy and Bahraini Personal Data Protection Law (Law No. 30 of 2018).
- CPR data may be requested for AML/KYC purposes and shared with authorities when required by law.

14. Account Suspension and Termination

5dmaty may suspend or terminate any user account that:
- Violates these Terms
- Is involved in fraud or abusive conduct
- Is inactive or repeatedly violates platform norms

15. Dispute Resolution

- Clients and Vendors must attempt to resolve disputes directly.
- If unresolved, contact info@mofawada.com. 5dmaty will mediate but is not legally liable for outcomes.

16. Limitation of Liability

To the fullest extent permitted by law, 5dmaty disclaims all warranties, guarantees, and liability for the actions, services, products, or representations of Vendors. Any dispute, dissatisfaction, harm, or legal matter arising from services or products booked through the App must be resolved directly with the Vendor.

5dmaty is not liable for the actions, products, services, or conduct of Vendors. 5dmaty’s liability is limited to the value of any applicable service fee paid in the last 30 days.

17. Changes to Terms

These Terms may be updated periodically. Users will be notified of changes via in-app notices or email. Continued use implies acceptance.

18. Governing Law

These Terms are governed by the laws of the Kingdom of Bahrain. Any disputes will be resolved in the courts of Bahrain.
